By accessing and using the services provided by SmartBoostify d.o.o. ("SmartBoostify," "we," "us," or "our"), you accept and agree to be bound by the terms and provision of this agreement. SmartBoostify provides comprehensive point-of-sale (POS) systems and related services designed specifically for small restaurants and food service establishments. Our services include software licensing, hardware provision, installation, training, ongoing support, and maintenance of POS systems.

Payment for SmartBoostify services is due according to the terms specified in your service agreement. We accept various payment methods as outlined in your contract. Late payments may result in service suspension and additional fees. All prices are quoted in Euros (EUR) and include applicable taxes unless otherwise specified.
All content, software, designs, text, graphics, and other materials provided by SmartBoostify are protected by intellectual property laws and remain the exclusive property of SmartBoostify or its licensors. You are granted a limited, non-exclusive, non-transferable licence to use our services for your business operations. You may not reproduce, distribute, modify, or create derivative works from our proprietary materials without explicit written permission.
Your privacy is important to us. The collection, use, and protection of your personal data are governed by our Privacy Policy, which forms an integral part of these Terms of Service. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.
While we strive to provide uninterrupted service, SmartBoostify does not guarantee that our services will be available at all times. We may experience downtime due to maintenance, updates, or unforeseen circumstances. We will make reasonable efforts to provide advance notice of scheduled maintenance whenever possible.
To the fullest extent permitted by applicable law, SmartBoostify shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of our services. Our total liability for any claims arising from these Terms of Service shall not exceed the amount paid by you for our services in the twelve months preceding the claim.
You agree to indemnify, defend, and hold harmless SmartBoostify and its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses arising from your use of our services or violation of these Terms of Service.
Either party may terminate the service agreement with appropriate notice as specified in your contract. SmartBoostify reserves the right to suspend or terminate your access to our services immediately if you violate these Terms of Service or fail to pay required fees. Upon termination, your right to use our services will cease immediately, though certain provisions of these terms will survive termination.
These Terms of Service are governed by and construed in accordance with the laws of the Republic of Croatia. Any disputes arising from or relating to these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts in Zadar, Croatia. If any provision of these terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
SmartBoostify reserves the right to modify these Terms of Service at any time. We will provide notice of material changes by posting the updated terms on our website and updating the "Last updated" date. Your continued use of our services after such modifications constitutes acceptance of the updated terms.
SmartBoostify shall not be liable for any failure or delay in performance under these Terms of Service which is due to fire, flood, earthquake, pandemic, governmental action, war, terrorism, or other causes beyond our reasonable control.
